    I like the non exclusive agreement...agents are lying to me thst i have sign a exclusive...i am full of ire. I am investor ...i can take care of myself. I dont like feeling like i dont have a choice...i am so angry i will quit buying anything in mls...furthermore, if i find a property on my own...i dont want pay commission or put up with realtor. I can live with nonexclusive and property specifics..i give u my name but i am not giving u personal information like dk and ss if i am not turning a offer in. I provide proof of funds or pre-approval letters...u not getting my personal information I okay with p

      Hi Debbie, starting in August, the requirement is that agents MUST have a buyer agency agreement signed, but you're right, there are no rules as to whether it's exclusive, how much the fees are, etc. Sounds like you just need to find someone to work with who is a good fit for YOU! Skipping anything on the MLS will reduce your buying opportunities, right? Just like skipping off-market opportunities will...

    If a buyer goes in from an open house and wants the listing agent to write the contract BUYER NEEDS TO ASK listing agent first if the seller is offering anything for a buyers agent before you ask him or her to write the contact for you as an unrepresented buyer?That buyer does not have to sign a buyers agents agreement with that listing agent because he or she is getting paid by the seller.

      My understanding is that the new buyer agency requirement doesn't apply to open house attendees. Buyers can certainly ASK to be represented though, in which case they would need to sign one. However, unrepresented buyers will pose some interesting dilemmas. I'm not sure I agree with everything you wrote above, but we'll see how it shakes out. Why would an unrepresented buyer care if buyer agent compensation is being offered? Plus, I think the majority of buyers WANT representation. Not all, but most. But we'll see...

      @@clevelandrealestate As an un represented buyer you would want to know before you use the listing agent because you could get a buyers agent to represent you if the seller is paying for a buyers agent.If you go in as an unrepresented buyer because you are told no buyers agent commission is being offered but it is that agent would get both sides of the commissions. ,Buyers who do not want to pay for a buyers agent will and are going to the listing agents and they need proof if the seller is not offering to pay something for a buyers agent.

    If the buyer refuses to sign the BAA, they should have the option to decline by initialing the buyer's agency agreement form. That also protects the broker's responsibility.

      It really depends on what your purchase agreement says (it's a contract, so you want to make sure you're not breaking it). Plus before considering changing lenders, make sure you can still be ready for the closing date. I'd discuss with your agent or an attorney. What state are you in?

    Unless a person is going to write a contract they should not have to sign a buyers agent agreement.Also if someone signs a buyers agent agreement they can date that agreement for just that one day it does not need to be for any longer time unless they want it to be.Are you saying that after you take a listing agreement asking how much commission the seller is willing to pay that that person does not know that commission is going to you and a buyers agent which is another agent as payment for sale of that house?This lawsuit was about sellers not being told they did not have to pay a buyers agent.It nothing to do with people not knowing how agents got paid.Also you running people around as a buyers agent and the fees it costs you to be an agent is just part of your job sellers as a real estate agent.

      You couldn't be more wrong. 2 facets of the proposed settlement are: REQUIREMENT of signed buyer's agreement before we even SHOW a property to a buyer. Second, compensation CANNOT be posted in the MLS. If you're suggesting that agents should just show properties and just HOPE they get compensated, that would be foolish. To follow the rules, agents and buyers will sign buyer agreements FIRST, then view properties. If the sellers don't pay the buyers' agents, the buyers will pay.       @@EMPTORADVOCATE-gt4rb thanks for taking the time to comment. Your feedback is most welcome! We currently do not plan to charge just for showings, but that's an interesting question. Would the public be better-served if they had to pay hourly for showings? If Realtors were employees and not 1099 contractors? If you were shopping, would you want to pay hourly? I took a quick look at your last video which talked about filling in the blanks on the listing agreement. Sellers could always ask to put a ZERO there, right? Or $1, which was the minimum in many MLS's. But does that really benefit them? I would argue that offering to pay buyer's agents actually HELPS sellers get more showings, more offers, and a higher price. My evidence? Why do many FSBOs offer to pay buyer agents for bringing a buyer at an acceptable price? Because they are generous? Of course not! It's because they know that offering to pay buyer's agents gets them more activity. It's the perfect form of free-market capitalism. Those sellers could say NO commission to buyer agents and yet they choose to offer one. No one is forcing them to do so.

    I’m in Cleveland and this is the 3rd time I’ve been denied a transaction by my broker on the listing side for different reasons… I had promoted a property in distress as an off-market opportunity.. We got under contract and my broker told me a couldn’t work on the transaction because they don’t work with wholesalers. I literally had to step out of the transaction as the listing agent because it was the best offer I was going to get for my clients and we already put this under contract for exactly what they wanted.. I’m out here kicking rocks, thinking this is stupid..and up pops this video. 🙂‍↕️

      Hi, each broker's policy is different. Our brokerage, for example, does not allow wholesaling. Our insurance doesn't cover us. Other brokerages DO allow it. You should probably investigate what your brokerage does allow to see if you can do what you're trying to do. If they don't, check around to see who does allow it.

    I always buy from the listing agent to let them make more commission and to make my offer more attractive. Plus the seller pays less commission. Another plus.

      Whatever works for you, but I bet you've made some listing agents VERY happy as they collect both sides of the commission, as they are not required to reduce it! And you have no representation....

      @@xamatox it varies state by state. In Ohio, we have dual agency where in theory, the list agent COULD rep both parties. But they become quite limited on how they can serve both clients. Some states don't allow dual agency, so the list agent essentially becomes an admin for the transaction

    Have to respectfully disagree on this one , Mike. You could make a rule, without it falling under the ambiguous title of "ethics". NAR has no problem with people posting 3 for commission, knowing it clearly looks like 3% (one example)To me, what is ethical about requiring in most places( excluding that one example mentioned) a Nar membership to utilize the MLS. Decouple them and let them prove their value. Most agents realize they need the MLS, and it is required if the broker is a member. Just like cable companies, when other options finally happen, and one day they will. NAR will see just how much many agents do not want the membership.

    1. Explain they can cancel anytime if they are not happy with the way things are going. 2. Explain your value. 3. Explain how it is that you get paid exp, we pay for gas, time, etc. We are commison only. The one I like is, I am not guranteed anything. I have a booklet on what we do. I printed it and put it on a binder.

We certainly want to explain HOW we get paid, because many people just don't understand it, but we also realize that many don't really care. So we focus on how we help them, why we're valuable to them.

    I was discussing giving gifts for referrals, not kickbacks, at a local meeting and I was told it was not allowed. Where should I go to confirm yes or no on this practice? I'm in Virginia.

      Hi, I'd check w/ your broker or manager, or your local board, but in general, in Ohio and with NAR, gifts for referrals is not against the Code of Ethics. As you said, "kickbacks" or compensation for closings, if not allowed. You can do all kinds of things, like contests, drawings, etc, and generally, this is ok as long as you're not paying unlicensed people for closings. I hope that helps!
